ImgSEO – Terms of Service and Privacy Policy

1. Introduction

Welcome to ImgSEO (“Service”, “we”, “our”, “us”). By accessing or using our Service—including our WordPress plugin, API, cloud dashboard, and browser extension—you agree to be bound by these Terms of Service and Privacy Policy (collectively, the “Agreement”). If you do not agree, you must not use the Service.

2. Service Description

ImgSEO provides AI-powered image optimization, including:

  • Automatic generation of SEO-optimized alt text and metadata.

  • Smart file renaming and structured data.

  • Bulk optimization and API access.

  • Cloud dashboard and team management.

The Service assists with compliance to accessibility standards but does not guarantee full legal compliance in all jurisdictions.

3. Account Registration

  • You must provide accurate and complete information.

  • You are responsible for safeguarding your credentials.

  • Accounts are non-transferable.

  • We may suspend or terminate accounts that violate this Agreement.

4. Credits and Payments

  • ImgSEO operates on a credit-based system only.

  • Users may purchase credit packs as published on imgseo.net.

  • Credits do not expire and remain available until used.

  • Free tier users receive starter credits plus daily refills when their balance is low.

  • All purchases are final and non-refundable, except where required by law.

  • Prices may change; users will be notified in advance.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes.

  • Upload or process infringing, offensive, or illegal content.

  • Circumvent rate limits, resell credits, or share API keys.

  • Reverse-engineer or tamper with the software.

6. Intellectual Property

  • You retain rights to your uploaded images.

  • You grant us a limited license to process your images for optimization.

  • Generated alt text and metadata are licensed to you for your business use.

  • ImgSEO software, algorithms, and AI models remain our exclusive property.

7. Service Availability

  • We strive for 99.9% uptime, but availability is not guaranteed.

  • Features may be modified or discontinued with notice.

  • Maintenance windows will be announced when possible.

8. Limitation of Liability

  • The Service is provided “as is” and “as available.”

  • We make no warranties regarding uninterrupted service, accuracy of AI output, or guaranteed compliance.

  • To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages (including SEO loss, fines, or data loss).

  • Our total liability shall not exceed the fees paid in the past 12 months.

9. Privacy Policy

9.1 Information We Use to provide our service

  • Provided by you: account details, billing information, uploaded images, site URLs.

  • Automatically collected: API usage data, plugin/extension activity

9.2 How We Use Data

  • To deliver our AI services.

  • To process alt text generation and metadata.

  • To manage credit purchases.

  • To prevent abuse and ensure security.

  • To send service updates and legal notices.

9.3 Data Retention

  • Uploaded images are processed in real-time and deleted after processing (except temporary caching).

  • Account and billing records are retained as required by law.

  • Users may request deletion at any time.

9.4 Legal Bases (GDPR)

Processing is based on:

  • Performance of a contract (providing the Service).

  • Compliance with legal obligations.

  • Legitimate interest (security, analytics).

  • Consent (marketing communications, optional).

9.5 Data Sharing

We do not sell personal data. We may share information only:

  • With payment processors and service providers.

  • If required by law or government request.

  • With your consent.

9.6 International Transfers

Data may be processed in the EU or other jurisdictions. When data is transferred outside the EU, safeguards such as Standard Contractual Clauses (SCCs) apply.

9.7 Your Rights

You may:

  • Access, correct, or delete your data.

  • Withdraw consent at any time.

  • Export your data in portable format.

  • Object to processing or request restriction.

  • File a complaint with a supervisory authority.

9.8 CCPA/CPRA (California)

California residents have rights to:

  • Know what data is collected and how it’s used.

  • Request deletion of their personal data.

  • Opt out of sale or sharing of data (ImgSEO does not sell data).

  • Non-discrimination for exercising privacy rights.

9.9 Children’s Privacy

The Service is not intended for users under 16. We do not knowingly collect children’s data.

10. Accessibility Statement

ImgSEO aims to meet WCAG 2.1 AA and comply with the European Accessibility Act (from June 28, 2025). Our admin interfaces follow WordPress accessibility guidelines and are tested with screen readers. Please report issues so we can improve.

11. Changes to this Agreement

We may update these Terms and Privacy Policy from time to time. Significant changes will be notified by email or via the Service. Continued use after changes constitutes acceptance.

12. Governing Law and Jurisdiction

This Agreement is governed by the laws of Italy and applicable EU regulations, without regard to conflict of law rules. For international users, mandatory consumer protections of your jurisdiction remain unaffected.
